拍賣規則
一、 競標價加價表:(Minimum auction bidding increments) 1~1,000元 最低加價金額:50元 1,001~3,000元 最低加價金額:100元 3,001~5,000元 最低加價金額:200元 5,001~10,000元 最低加價金額:375元 10,001~30,000元 最低加價金額:1,000元 30,001~70,000元 最低加價金額:2,500元 70,001~100,000元 最低加價金額:4,250元 100,000以上 最低加價金額:5,000元 二、 銷售條款 A: 凡例 (一)本目錄所指稱的拍賣人為天下郵幣社;買方為競標者;賣方為出品者。 (二)本目錄將以新台幣為計價單位,如以外幣交易僅限美元,並以競標截止日依 臺灣銀行買進匯率為交換匯率。 (三)目錄上每一項目拍品均加註底價,最高競標價只有在至少不低於底價時方能 成交(即為買方),其最後的決標價是依 下列所述計算:如第二高競標價亦 不低於底價時,其最後的決標價是依第二高競標價加10%。但以不超過第一 高競標價為準。除此之外,倘無第二高競標價、或者第二高競標價不及底價 時,其決標價依底價加10%。依此所計算之最後決標價,亦不得超過最高競標 價。 (四)買方參加競標,即自動確認遵守本拍賣目錄所列之各項條款,並完全接受台 北地方法院擁有排它性的管權。 (五)賣方於出品時,即自動確認遵守本拍賣目錄所列之各項條款,並完全授予拍 賣人於拍品所為之重新包裝,照相,掃描,影印,光碟及網頁,目錄,廣告 、海報等製作販售之權利,並完全接受台北地方法院擁有排它性的管轄權。 (六)本拍賣目錄之各項說明係以中文為準,英文為輔,如中文英文間有任何語意 上的出入,概以中文為解釋的標準。 (七)拍賣人僅係以代理人之身份執行拍賣各項業務,於任何買賣雙方爭議,或因 而引起的索賠等法律行為,除提供必要的諮詢意見外,概不負責。 三、 買方條款 (一)買方應於截標日前,填妥競標表格,以傳真或郵寄方式進行,並以拍賣人收 到之日為準,逾期概不受理。 (二)拍賣人作為賣方代理人身份進行拍賣各項業務的事宜,除另有協議外,在 本公司拍賣中或已成交之拍賣物品,即自動形成賣方經由本公司之代理與 買方達成拍賣合約。 (三)拍賣人得要求初次競標者,於截標前兩日,提供個人信用資料,如有任何疑 慮,拍賣人得不經任何解釋婉拒競標。 (四)買方於預覽日期間,當場預覽拍品,惟得標後,已預覽項目,不論任何理由 均不得要求退標。 (五)較高價的拍品或同一拍品內有多種品項等級,難以逐一描述時,拍賣人將以 *記號註記於內容說明之前,買方須於截標日前,作當場鑑識,以確認真品 及拍品所為之之品相描述等級;惟得標後,不論任何理由均不得要求退標。 (六)得標的買方除支付決標價金外,另須支付予拍賣人酬金。依決標價金另加計 10%為佣金。 (七)得標的買主,須由接到通知後5日內以現金付清所有款項,如須出口,或郵 寄,保險,銀行服務等所延伸的相關費用,概由買方負責。 (八)買主如有未能於上述約定日以現金付清全部款項,含未兌現之支票,拍賣人 即有權利進行單項或多項權利及其補救辦法。 8-1. 買方須支付中央銀行牌告利率加5%,計算所積欠價款之利息。 8-2. 拍賣人得與出品者協議,重售,如有因而招致之直接間接之損失及費用, 概由買方負責。 (九)買方雖已付款,然由付款日起7日內,經正常程序未能提貨時,拍賣人得將 拍品存放於銀行保管箱中,相關費用或損失,概由買方負擔。 (十)如能由拍賣人鑑定確為膺品的物件,交易即被取消,並將款項退還給買方, 然不得因而要求任何利息之補償,如 需經由特殊機構鑑定,其費用以新臺 幣1000元為限,逾此概由買方負擔,如確為真品時,拍賣人將收回新台幣 1000元之補貼。 (十一)相關拍品均依實物狀況出售,如與目錄之描述不符時,概依實物為準,拍 賣人保留買主所認可之專家的任何意見。 (十二)買主於收到拍品超過7日未經約定程序提出書面要求退貨,則拍賣人有絕 對權力拒絕退貨。 (十三)買主於收到拍品時未得拍賣人同意前,買主不得就拍品拆封或變更包裝方 式,否則拍賣人有絕對權力拒絕退貨。 (十四)同拍品如有相同競標價格出現時,概以拍賣人收到相關資訊時間先後為準 ,先到者即為成功的買主。 (十五)買方出價高於底價,但是金額未達到競標價遞增表所列級距, 拍賣人保 有權力降低為次一級, 同時買方並不享有同一競標價之優先權。 (十六)郵寄之得標品,得標人除支付運費外,須另支付相關保險費, 如因未繳 保險費而發生之遺失或相關損失時,概由買方負擔。 (十七)大陸地區買主,對其以後所拍得的金銀幣,其交寄地址僅限於得標人所 指定之香港地址代收,紙類收藏品則可依得標人指定地址交寄。 四、 出品人 --- 賣方之條款 (一)拍賣人對於任何有爭議性的拍品,或拍品的品相等級有不同見解時,得諮詢 由拍賣人所認可之各領域之收藏名家所提供的鑑定意見;拍賣人擁有絕對權 力處理所有的拍賣程序,婉拒有爭議性的拍品,或目錄發行後取消任何拍品 ,均毋需作任何解釋。 (二)賣方堅持以高價出品,因而未能如期拍出時,拍賣人得視情況酌收依出品價 1~3%之製作費用,並將經協商後之費用比率,明訂於出品單上。 (三)拍賣人得視出品人之拍品水準的高低及可能成交金額的多寡,彈性調整出品 佣金,由5% ~ 10%不等,依決標價另加計算。 (四)高單價之拍品另行依出品人要求,附加保險外,本公司應善盡保管人之義務 將拍品妥善保管,或暫儲存於銀行的保險箱。 (五)出品人對拍賣品所作之承認: 5-1. 出品人如有意圖不良,拍賣人保有對出品人法律索賠之權力。 5-2. 拍賣品確為出品人全部權利唯一的所有者,具備將所有權轉讓予買主之無 限權利,與第三人之權利典當,質押無涉。 (六)拍賣人於付款予出品人後,如發現確為膺品,賣方應將款項悉數退還,且並 得行使留置權。 (七)如所託售之拍品未能如期拍出,出品人須於拍賣截止日後30日內領回,違者 拍賣人將不負擔保管之責任,其因而所引起的直間接費用,將視情況向出品 人索賠。 (八)如未能如期拍出,拍賣人自動獲授權為出品人獨家代理人,另按與出品人協 議之新價格出售。 (九)拍賣人擁有絕對權力對出品物作相關銷售等事宜,含目錄、網頁、廣告、海 報等圖檔之編輯、發行與製作販售權力。 (十)出品單將於截標日後60天內自動失效,出品人須於失效日前持出品單前來結 清。逾期概不受理。 Terms and Conditions (1) A.General articles. 1.The “auctioneer” in this brochure refers to “Global Coin and Stamp Co.”; “buyers” refers to “bidders”, and “sellers” refers to “consignors”. 2.New Taiwan Dollar (NT$) is used in all transactions.We also accept US dollar at a foreign currency rate posted by Bank of Taiwan at the sale day. 3.Each lot in this brochure has a reserved price.The highest bid that is at least the reserved price of a lot is the winning bid.The final“hammer price” for each lot is calculated as follows.If here is a second highest bid whose amount is at least the reserved price, the final “hammer price” is either 10% over the second highest bid or the highest bid, depending on which one is lower.Otherwise, the final“hammer price”is either 10% over the reserved price or the highest bid, depending on which one is lower. 4.In submitting bids, buyers agree to adhere to the terms and conditions in this brochure and to in accept the jurisdiction of the Taipei Local Court House for any disputes arisen from the sale. 5.In consigning lots, consignors agree to grant the auctioneers the right to repack, photo, scan, advertise, which will include post of internet, CD, post printingand catalog for each lot and to accept the jurisdiction of the Taipei Local Court House for any disputes arisen from the sale. 6.In this brochure all descriptions are given in Chinese with optional English translations.Chinese version is official with regards to resolving any dispute arisen from the sale. 7.Unless otherwise stated, the auctioneer acts only as agent for a consignor and disclaims all warranties related to any material offered in the auction.The auctioneer further assumes no risk, liability or responsibility for any lots. All statements in this brochure are opinions only. (2) B.Articles for Bidders. 1. All effective bids should be received by fax or mail before the close date. 2. Unless stated otherwise, each bidder should guarantee prompt payment and agree to be liable for the consequence for bidding. 3. To run a fair and effective auction, the auctioneer reserves the right to require first-time bidders to provide satisfactory credit references and to reject bids from person failing to do so well in advance. 4. The auctioneer recommends personal viewing of the lots at least three days before the sale to carefully check the items against the descriptions in the brochure. However, no lots purchased by the persons who viewed the lots in advance may be returned. 5. The lot with mark including different articles with varies conditions and in a high reserved price, would be purchased with no return at any reason. The buyer should check the items carefully in advance. 6. A 10% buyer’s charge will be added to the final hammer price. 7. The buyers winning lots must make the payments including shipping and handling, within 5 days. Additional insurance can be arranged at buyers’ costs. The buyer should compensate for the loss or damage occurred by the reject of the insurance to the lot on the delivery. 8. Buyers fail to make all payments, including check payment, in the above time period, will face one or two following possible penalties determined solely by the auctioneer: 8-1. Interest on unpaid balance will be charged at a rate posted by of Bank of Taiwan plus 5% extra charge. 8-2. After consulting with the original consignors, the bidder can ask for the resale of winning lots, within possible losses compensated by the buyers. 9. Lots not picked up by buyers 7 days after the payments will be kept in our bank safe with a fee. 10.Items claimed by buyers as forgeries and accepted as so by the auctioneer will be promptly refunded. The auctioneer holds no legal responsibility and offers no additional compensation for returned forgeries. The auctioneer will also reimburse the buyers up to NT$1000 for any fee paid on authentication if the items are determined to be forgeries and accepted as o by the auctioneer. 11.All items illustrated and described in the brochure are the actual items to be sold. in case of errors in the brochure the actual items in the sale overrule. 12.Buyers have not right to return if a written request does not reach to the auctioneer within 7 days after receiving the items. 13.Unless approved by the auctioneer, items removed from original holders cannot be returned. 14.In case of identical bids, the earliest bid wins. 15.The auctioneer reserves the right to lower your bid price to the next normal increment if the bid price or increments other than those listed, and thebidder will not take precedence over normal level bids received earlier. 16.The successful bided article requested to mail to the address of outside Taiwan area, the buyer should bear the freight charge plus the insurance. 17.The buyer at the address within China should appoint his agent at Hong Kong to receive the successful bid article of gold and silver coins excluding the paper articles. (3) C.Articles for Consignors. 1. The auctioneer has the right to assign grades, to provide adequate descriptions to all lots and to consult connoisseurs about questionable items.The auctioneer whose decision is final reserves the right to reject lots without any justification. 2. If the consigned article was not successful bided due to the consignor had not agreed to reduce their offered price, the consignor will be charged the issue fee with 1-3% from their offered price. 3. Depending on the final “hammer price”, the commission is between 5% to 10% and is negotiable. 4. Unless requested by consignors to have the high-valued items additionally insured, all consignments are kept in our bank safe. 5. Consignors agree to compensate the auctioneer for any loss in occurred from the sale for not acting on good faith; the fact that the consignor is the sole owner of the consignments, without any partial third party ownership, and the consignments are not part of any security towards loans. 6. Consignors agree to promptly refund after payment is made if the consignments are determined to be forgeries and returned by buyers. 7. The auctioneer has the right to act as exclusive agent for the further resale of unsold items at prices mutually agreed by the auctioneer and consignors. 8. Unless the right of resale by the auctioneer is reestablished, consignors should pick up unsold items within 30 days after the sale. Thirty days after the sale, the auctioneer is no longer responsible for the safekeeping of the unsold items. Furthermore, storage fees will be charged if applicable. 9. The consignments are automatically and absolutely authorized by the consignor for the auctioneer the right to repack, photo, scan, advertise which will include the post on internet, edit on CD, brochures, post printing for the promotion of sales. 10.The consignor will be not allowed to return the consignment with any reason the confirmation of the contract with auctioneer. 11.The cinsignor should dettle down their account before the date after 60 days the closing date of the auction, or the agreement on consignment will be invalid automatically.
